Steel Flyover Vs Public Protest Vs Karnataka Government


In recent news regarding the construction of the proposed steel flyover in Karnataka has come down hard by local residents and opposition leaders. The steel flyover which is beginning from Chalukya Circle till Hebbal flyover which is proposed to help the traffic congestion this city faces. But several online petitions and public interest groups have been asking the government to reconsider the plan. Development Minister of Bangalore KJ George tweeted about the significance of constructing this flyover. He even posed questions and asked the Bangalore Development Authority on how the steel bridge would help and impact the environment.
The report states that the section of road between Basaveshwara Circle to Hebbal, a total of 6.7 km is one of those roads in Bangalore constantly busy and congested during peak hours. The existing land use pattern is such that horizontal widening of existing road is practically not possible.
The other reason for this proposed flyover is to make it signal free. To reduce time and delay, to increase travel speed, to cater to future project traffic, to cater for airport bound traffic and to cater to unhindered traffic from NH-7.

Government decision on the flyover is that a lot of consideration was taken before this conclusion was made. Even the Chief Minister of Karnataka Siddaramaih has defended the stand on the steel flyover. The Chief Minister replied in a cheeky manner when was asked on why an insurmountable amount of money (1791 crores) is being spent for this flyover, his reply was Will you fly to avoid the traffic congestions in the city.
The residents of Bangalore who have initiated the anti-steel flyover movement is that not only an large amount of money is wasted but also it would be a cause for concern for the environment as close to 812 tress will be knocked down to build this project. But Development Minister KJ George has vowed to plant 6000 ornamental plants to compensate for those tress felled.

Opposition groups such as Rajya Sabha MP Rajeev Chandrasekhar’s Namma Bengaluru Foundation and Bangalore’s prominent citizen such as actor Prakash Belawadi, noted architect Naresh Narasimhan and urban expert Ashwin Mahesh have all voiced their displeasure. Bangalore urban Minister KJ George has welcomed the opinion of the public through his twitter handle @thekjgeorge.
It remains to be seen what will be the fate of this proposed steel flyover as public and various opposing parties clash with the government. There are several social media campaigns like traffic free Bangalore to collect public opinion are also running in the city.

BBMP loses a developed PARK for the second time

This is the second time BBMP lost 16 guntas of land if you have remembered our previous post on how court verdict BBMP to loose plot and now  it is finalized. The land which measures about 17, 425 sq. ft. and was a well-developed park in Jaraganahalli, off Bannerghatta Road close to J P Nagar to one Mr. V Krishna Murthy. On February 2016 BBMP lost 10, 889 sq. ft. of park land located at Koramangala V Block to a Jayanagar resident Mr. Pratap Kumar Reddy. This park is situated in Bommanahalli and the price of 17, 425 sq. ft. of land costs around Rs. 14 crores at the rate of Rs. 8, 000 per square feet. The first one that BBMP lost was estimated to be costing about Rs. 20 crores.
This park that was lost by BBMP to Mr. V Krishna Murthy consisted of a play area, pathways and a garden. This was developed by BBMP at a cost of Rs. 1.5 crores which is necessarily tax payer’s money. BBMP developed the park and fenced it and subsequently fought a law suit with Mr. Murthy for eight years.

After eight years BBMP lost the case on the final verdict of the court on April the 5th 2016 in the XXVII additional City Civil Court to Mr. Murthy.
In the final verdict the court directed the BBMP to remove the fencing of barbed wire and also to demolish the cemented road in the park. Subsequently BBMP should hand over the possession of the park to Mr. Murthy. The court ordered that Mr. Murthy is the sole owner of the property with survey no. 72/1A2 and the other is the OS no. 591/2003.
After one of the defendants, Mr. J N Lokesh working as an Assistant Engineer did not appear in the court for the purpose of cross examination, was the case discarded. Subsequently another assistant engineer who was another defendant appeared and was examined. In his written statement he maintained that Sy. No. 72/1A is in the name of Mr. V Krishna Murthy.
The lower court passed the judgement stating that the government had acquired the 3 acres of the said land for the purpose of constructing the residential layouts which was meant to be distributed to the economically weaker sections of the society. But the court gave the verdict that except for the land for the said purpose BBMP did not have any rights on the other remaining properties. Hence all the 16 guntas of the land does not belong to the BBMP.
The court maintained that Mr. Murthy had put a compound wall and also did construct a shed on the property. This meant, the court maintained that he was in the lawful possession of the property. On top of that the court also maintained that the records show that Mr. Murthy has sold only five acres of land out of the 16 guntas. The court maintained that this land was fenced by BBMP on the deputy commissioner’s directions on the date of February 24th 2014 in the presence of the police officials.

THE COURT VERDICTS AGAINST BBMP AND IT LOOSES A PLOT.

The BBMP has recently lost a 10, 889 sq. ft. park in the Koramangala V Block. This has been the Verdict of the City Civil Court after a five year long suit that the BBMP fought with a private party Pratap Kumar Reddy who is a resident of Jayanagar who had been claiming that the land belongs to him. He also produced relevant documents to prove it. 

The experts say that even by a conservative estimate the land would cost or is worth around Rs. 20 crore at least. The BBMP however said that it has plans to approach the higher court against the judgement of the City Civil Court.  But although said there isn’t any movement noticed by the BBMP that has been noticed in these five months. Although there are opinions   that suggest that BBMP did not attempt to win or did not put the necessary efforts to win the case.  

Vishwanath Kashyap of the Task Force of the Koramangala Infrastructure wing blamed the advocates of the BBMP saying that it is the mistake of the lawyer who did not plead properly. The reason he cited was that the plaintiff claimed that the Beauty spot was survey number 32/ 16 and not 23 which is the area of the actual plot. He further said that the BBMP should have clearly stated that he did not have any stake in survey no. 32/16. He said the case would have ended there but went on for five long years.  

The XXVI additional City Civil Court Judge Mallappa Veerappa Jadar gave the verdict issuing a permanent injunction against the defendant, their agents and the henchmen and they will be refrained from any kind of interference of peace with the disruption of peaceful possession and the enjoyment of the property unless the plaintiff is evicted from the property by the due process of law. 

On the other hand the BBMP claims that the BDA (Bangalore Development Authority) owned the land originally and was in physical possession of the property but handed it over for maintainance and for the land to be developed in to a park or a beauty spot. The Mayor B N Manjunath Reddy opined that it has been brought to his notice and he is aware that BBMP has lost the possession and ownership of the land to a private party.

Almost 10,472 acres of Bangalore lake land grabbed

Sensational news was revealed by a committee constituted by the Karnataka assembly which said that lakes and water bodies have been encroached in Bengaluru in both rural and urban areas to an extent of 10, 472 acres worth Rs. 1.5 lakh crores. This was revealed after a physical survey is being done by an 11 member committee of the legislative assembly. The committee was headed by K B Koliwad who found out that there are major land developers encroaching in the lake lands and as per Mr. Koliwad, notices have also been sent to them. 

In a statement to the media Mr. Koliwad stated that such a huge land stretch as big as 10, 472 has been encroached by the land developers. He also stated that the department would be sending show cause notices to them. He said the show cause notices would demand the reasons as to why they should not be evicted from the land. He also stated that the reply should come before 30th of January, 2016. 

The committee which was duly formed 14 months ago said that the names, details of the land grabbers will be published in the official gazette notification along with the extent of the land grabbed will also be published in the gazette notification. 


The committee in its report published that 11, 595 people and government agencies have been alleged to have grabbed land in the tank areas and they have developed commercial and residential buildings, colleges, schools, community halls and others. In the 17 page report of the committee headed by Koliwad it stated that there are several government agencies, departments like BDA, BBMP, Education department, Urban development, Transport Department and forest department have also encroached the tanks. 

The committee appointed for the investigation hired 200 surveyors and have checked all the tanks in the two districts. The Tashildars would issue notices to the land grabbers and the Assistant Commissioners would collect the explanations of the land grabbing by the builders and developers and forward it as was said by the Chairman, Mr. Koliwad. This panel so constituted will take four months to submit the full and final report to the government. According to the report the Bangalore Development Authority (BDA) has allegedly encroached about 481 acres of lands of the tanks and developed various layouts and sites. Among the people who have been distributed the land, Chief Minister Siddharamaiah and Assembly Speaker Mr. Kagodu Thimappa, is also there. Both have been given land in Dollar’s Colony in J P Nagar and both have sold the land to the other parties. 

Mr. Koliwad said that the officials who had sanctioned such plans by generating fake documents for the developers to build the projects will have to face criminal cases lodged against them. He also said that if the officials are found to be in nexus with the developers they will be sent to prison and penalties will also be imposed. 

After the thorough study of the explanations given by the land grabbers the panel would evolve a plan of regularization or eviction from the properties. But he also stated that the panel so constituted does not have any powers to demolish the buildings.
